Terms of Service
The terms that govern your use of HillGen.
Last updated
Draft for legal review. This is a plain-language starting point written by the HillGen team, not legal advice. Items in [brackets] must be filled in, and a lawyer licensed where [HillGen’s legal entity] is established should review the whole document before launch.
These terms are an agreement between you and [HillGen legal entity name] (“HillGen”, “we”, “us”). They apply when you create an account, visit hillgen.com, or use the HillGen app at app.hillgen.com (together, the “Service”). By using the Service you agree to them. If you use the Service on behalf of a company, you confirm you may bind that company, and “you” means the company.
1. What HillGen is
HillGen is a studio for generating images, video clips and audio with third-party AI models. You write a prompt, optionally attach reference files, choose a model and settings, and the Service sends your request to the model’s provider and stores the result in your workspace. HillGen does not train models of its own.
2. Your account
You need to be at least 18 years old to use the Service. Sign in with Google or with a one-time code sent to your email. You are responsible for what happens under your account, including anything done by people you invite to a team workspace. Tell us at [support email] if you believe your account has been accessed without your permission.
3. Workspaces, teams and roles
Everything you make belongs to a workspace. A personal workspace is yours alone. A team workspace has an owner, who controls billing and can delete the workspace, and admins and members, who can create and run generations. The owner of a team workspace is responsible for its members’ use of the Service and for its charges.
4. Credits and payment
Generations cost credits. The price of each generation is shown in the app before you run it and depends on the model, its settings and, for some models, the length of the output or script. A failed generation is refunded automatically.
Every plan starts with a 7-day free trial. A payment method is required to start it, and the first payment is taken automatically when the trial ends unless you cancel before then. A trial is available once per account and includes a small one-time grant of trial credits. Paid plans grant a monthly allowance of credits on each billing date and are billed in advance, monthly or yearly, through our payment processor, Stripe. Yearly plans are charged once a year and credited month by month. Unused credits roll over into the next month, up to one month’s allowance. Credits have no cash value, cannot be transferred between workspaces, and expire when a workspace is deleted.
You can change or cancel your plan at any time from Billing in the app. A cancellation takes effect at the end of the current billing period; you keep access until then. Plan changes that increase your allowance take effect immediately and are prorated; changes that decrease it take effect at your next renewal. Except where the law requires otherwise, payments are non-refundable.
We may change prices or credit costs. Changes to credit costs take effect when published in the app. Changes to plan prices take effect at your next renewal after we notify you by email at least [30] days in advance.
5. Your content
You keep all rights you have in the prompts and files you upload (“Inputs”). You give HillGen a licence to store, process and transmit your Inputs and the generated results (“Outputs”) as needed to run the Service, including sending Inputs to the model providers you choose.
Between you and HillGen, you own the Outputs you generate, and you may use them commercially, subject to the next two sections. HillGen makes no claim to them. You understand that the same or similar Outputs may be generated for other users, and that whether an AI-generated work can be protected by copyright varies by jurisdiction.
You are responsible for your Inputs. Only upload material you have the right to use, including the likeness and voice of any real person it depicts.
6. Model providers
Each model is run by a third party (for example Replicate, Higgsfield, Fish Audio or ElevenLabs, as listed in the app). When you run a generation, your Inputs are sent to that provider and processed under its terms and privacy policy. Providers may refuse a request their moderation flags; such a generation is refunded. Your use of Outputs must also comply with the applicable provider’s acceptable-use terms, which we link from the app where available.
7. What you may not do
You may not use the Service to create or distribute content that:
- is sexual in nature involving minors, or depicts real people in sexual or intimate contexts without their consent;
- impersonates a real person in a way intended to deceive, including synthetic voices or faces used for fraud or harassment;
- is designed to mislead about matters of public importance, such as fabricated news footage or election material presented as real;
- infringes someone else’s copyright, trademark or other rights;
- is unlawful where you are or where it is distributed, or promotes violence or hatred against people based on who they are.
You also may not attempt to circumvent credit limits, rate limits or provider moderation, resell access to the Service, or use automated tools to access it other than through features we provide.
We may remove content and suspend or terminate accounts that violate these rules, and we may report unlawful content to the authorities where required.
8. Storage and deletion
Outputs and uploaded files are stored on Cloudflare R2 and remain available in your workspace until you delete them or the workspace. You can delete individual generations and your whole account from the app. Deleting an account removes its workspaces, files and personal data within [30] days, except for records we must keep for tax, accounting or legal reasons (such as invoices and the credit ledger). Reference files you upload but never use in a generation are deleted automatically after one day.
9. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted operation. Models come and go: a provider may deprecate a model, in which case we remove it from the app and your existing Outputs remain. We may change or discontinue features with reasonable notice.
10. Disclaimers
The Service is provided “as is”. AI models can produce inaccurate, biased or unexpected results. We do not warrant that Outputs will be fit for any particular purpose, free of third-party rights, or safe to publish, and you are responsible for reviewing them before use. To the fullest extent permitted by law, we disclaim all implied warranties.
11. Limitation of liability
To the fullest extent permitted by law, HillGen is not liable for indirect, incidental or consequential damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot be limited by law.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms or if required by law, and we will refund any unused prepaid period if we terminate without cause.
13. Changes to these terms
We may update these terms. For material changes we will email account holders at least [14] days before they take effect. Continuing to use the Service after that date means you accept the new terms.
14. Governing law
These terms are governed by the laws of [jurisdiction], and disputes will be resolved in the courts of [venue], unless the consumer-protection law where you live gives you other rights.
